Terms of service
1. Definitions
Bookancy — [legal name to be confirmed], a booking agency established in Belgium. The Service — the Bookancy booking platform, its staff workspace, its website booking widget and the customer pages. The business — the business that subscribes to the Service, whatever its trade.
2. Accounts and access
- Each staff member uses a personal account. Accounts must not be shared, and passwords must be kept confidential.
- The business is responsible for who it gives access to and for removing access when someone leaves.
- Tell us immediately at security@bookancy.online if you suspect an account has been compromised.
3. Acceptable use
Use the Service only to manage your own business's bookings. Do not enter data you have no right to process, do not attempt to access other businesses' data, and do not probe, overload or reverse-engineer the Service.
4. Customer data and roles
The business is the data controller for customer data and must have a lawful basis to collect it, inform customers (for example with its own privacy notice), and answer customer requests. Bookancy processes customer data only on the business's documented instructions, as described in the privacy policy and the data processing agreement that forms part of these terms. Bookancy assists the business with security, breach notification within 72 hours, and data subject requests.
5. Availability and support
We aim for 99.5% monthly availability, excluding announced maintenance. Support is available by e-mail at hello@bookancy.online on business days. We may update the Service; material changes are announced in the application.
6. Fees
The business's subscription order forms part of these terms and states the plan, the add-ons and the monthly fee. Prices exclude VAT and are billed monthly in advance. Late payment may lead to suspension after written notice.
7. Intellectual property
The Service, its design and its software belong to Bookancy. The business keeps all rights to its own data and grants Bookancy only the licence needed to run the Service. On termination the business can export its bookings (spreadsheet export) for 30 days, after which the data is deleted or anonymised as described in the privacy policy.
8. Liability
Bookancy provides the Service with reasonable skill and care. To the extent permitted by law, Bookancy's total liability for any claim in a contract year is limited to the fees paid by the business in the twelve months before the claim. Neither party is liable for indirect or consequential loss such as lost profit or lost bookings, except in cases of intent, gross negligence, or breach of data protection obligations.
9. Termination
Either party may end the subscription at the end of the current billing period with one month's written notice. Bookancy may suspend or end access immediately for serious misuse or unpaid fees after notice.
10. Law and disputes
Belgian law applies. The courts of [court district to be confirmed], Belgium have jurisdiction, without prejudice to mandatory consumer protection rules where they apply.
11. Changes to these terms
We may update these terms; material changes are announced at least 30 days in advance in the application. Continued use after that date means acceptance.
